Terms of Service

Effective Date: November 6, 2025

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“Customer”, “you”) and Blue Moose Designs (“we”, “us”, “our”). By accessing or using our website, placing an order, or interacting with our services (collectively, the “Services”), you agree to be bound by these Terms.

1. Scope of Services

  • Providing tools to create, upload, and customize designs and products.
  • Manufacturing, printing, and fulfilling orders based on Customer-provided designs.
  • Operating e-commerce stores through the DecoNetwork platform and related services.

These Services are provided “as is.” We may modify or discontinue features at any time without notice.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. If you are under 18 but over 13, you may use the site only with parental or guardian consent. No one under 13 may submit data or place orders.

3. Account Responsibilities

You are responsible for maintaining confidentiality of login credentials, for all activities under your account, and for ensuring all information is accurate and current.

4. Acceptable Use

  • Do not upload or use content that infringes any copyright, trademark, privacy, or publicity right.
  • Do not upload unlawful, harassing, obscene, or defamatory material.
  • Do not distribute malware, interfere with network security, or attempt unauthorized access.
  • Do not use the site to promote competing businesses or mass solicitation.

Violation of these rules may result in suspension or termination without refund.

5. Intellectual Property and Customer Content

5.1 Ownership

All site software, designs, and materials remain property of Blue Moose Designs or its licensors. Customer retains ownership of artwork, logos, and designs they upload (“Customer Content”).

5.2 License to Produce

You grant Blue Moose Designs a non-exclusive, worldwide, royalty-free license to reproduce, modify (for technical production needs), and use Customer Content solely for manufacturing, displaying proofs, and fulfilling your orders. This license ends when the order is complete and a seven-year record-retention period expires.

5.3 Customer Warranties and Certification

  • You have full rights and permissions to use and reproduce the uploaded design.
  • The content does not infringe any copyright, trademark, privacy, or publicity rights.
  • You agree that checking the “I have permission to use this file” box constitutes an electronic signature and binding legal certification.
  • Blue Moose Designs may rely on your certification and is not responsible for verifying intellectual property ownership.
  • Blue Moose Designs will retain a record of your certification (including order ID, IP address, timestamp, and checkbox acknowledgment) for seven (7) years.

5.4 Hold Harmless and Indemnification

You agree to defend, indemnify, and hold harmless Blue Moose Designs, its affiliates, employees, contractors, and fulfillment partners from and against any claim, demand, loss, or expense (including attorneys’ fees) arising from or related to Customer Content — including, without limitation, copyright or trademark infringement, defamation, or violation of rights of publicity or privacy.

5.5 No Design Screening

Blue Moose Designs does not pre-screen, verify, or approve designs. You bear sole responsibility for ensuring your uploaded content is lawful and authorized for production. We may refuse or cancel orders suspected of infringement or illegality.

6. Orders, Proofs, and Approvals

  • Digital proofs must be carefully reviewed. Approval constitutes final authorization to proceed.
  • Blue Moose Designs is not responsible for typographical errors, color variation, or design positioning once approved.
  • Exact color matches cannot be guaranteed due to material and device variance; paid color-match services may be available.
  • Custom-made goods are non-returnable except for manufacturing defects reported within 7 days.
  • Industry-standard production variance up to ±5% may occur.

7. Payment Terms and Late Fees

  • All prices are shown before applicable taxes and shipping.
  • By submitting an order, you authorize charges to your selected payment method.
  • Commercial accounts: past-due invoices accrue interest at 1.5% per month (18% annual) or the maximum allowed by law, plus reasonable collection costs and attorney fees.
  • Consumer orders: a flat late fee may apply where permitted by law.
  • Unauthorized chargebacks on custom goods may result in account suspension and recovery of fees and costs.

8. Shipping and Risk of Loss

  • Delivery times are estimates. We are not liable for carrier delays or events beyond our control.
  • Risk of loss transfers upon carrier pickup or customer collection.
  • Inspect deliveries promptly and report issues within 3 business days.

9. Warranties and Liability Limitations

  • The Services and products are provided “AS IS” and “AS AVAILABLE.”
  • No warranties, express or implied, including merchantability or fitness for purpose, are given except where required by law.
  • To the maximum extent permitted by law, Blue Moose Designs’s total liability will not exceed the amount paid for the specific order giving rise to the claim or $100, whichever is greater.
  • We are not liable for indirect, incidental, or consequential damages, including loss of profit or goodwill.

10. DMCA Policy and Copyright Complaints

If you believe material on this site infringes your copyright, send a notice under 17 U.S.C. §512 to: sales@akbluemoose.com with subject “DMCA Notice.” Include your contact info, identification of the work, the infringing material’s location, and statements of good faith and accuracy under penalty of perjury. We may remove or disable access to the material and terminate repeat infringers.

11. International Data Protection (EU/EEA/UK)

If you are located in the European Union, European Economic Area, or United Kingdom, the following apply under the EU General Data Protection Regulation (GDPR) and UK GDPR:

  • Blue Moose Designs acts as “data controller” for customer account and order data processed via DecoNetwork.
  • Lawful bases for processing include contract performance, legitimate interests (order fulfillment, fraud prevention), and legal compliance.
  • Data may be transferred to and stored in the United States. We use recognized safeguards such as Standard Contractual Clauses or equivalent mechanisms.
  • You have the rights to access, rectify, erase, restrict processing, object to processing, and data portability.
  • To exercise rights or make a complaint, contact sales@akbluemoose.com. EU/UK residents may also lodge complaints with their local supervisory authority.
  • Custom goods are exempt from the EU/UK right of withdrawal once production has begun based on your approval.

12. Termination

Blue Moose Designs may suspend or terminate access at any time without notice for violation of these Terms or law. Termination does not relieve payment obligations already incurred. Sections 5, 6, 7, 9, 10, 11, 13, and 14 survive termination.

13. Dispute Resolution, Governing Law, and Venue

  • These Terms are governed by the laws of the State of Alaska, USA, without regard to conflicts of law principles.
  • Consumer Disputes – Arbitration or Small Claims: If you are an individual consumer, any dispute (except those eligible for Alaska small-claims court) will be resolved by binding arbitration in Anchorage, Alaska, under the Commercial Arbitration Rules of the American Arbitration Association. Either party may bring small claims directly in Alaska small-claims court. The prevailing party may recover reasonable attorney fees where permitted by law.
  • Commercial Disputes: Businesses agree to exclusive jurisdiction and venue of the state and federal courts located in Anchorage, Alaska.

14. Force Majeure

Blue Moose Designs is not liable for delays or failures due to events beyond reasonable control, including acts of nature, labor disputes, war, supply shortages, or system outages.

15. General Provisions

  • Severability: If any provision is found unenforceable, the remainder remains in effect.
  • Assignment: Blue Moose Designs may assign rights or obligations under these Terms. You may not assign without written consent.
  • Waiver: Failure to enforce any provision does not constitute a waiver.
  • Updates: We may update these Terms by posting a new version; continued use constitutes acceptance.
  • Entire Agreement: These Terms, along with our Privacy & Cookie Policy, form the complete agreement between you and Blue Moose Designs.
